By accessing or using SellMyGolfBalls.com ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. We reserve the right to modify these Terms at any time, and such modifications will be effective immediately upon posting. Your continued use of the Service constitutes acceptance of any modified Terms.
SellMyGolfBalls.com provides a platform for individuals to sell used golf balls. We purchase golf balls from sellers, mail a shipping kit containing bags, prepaid return labels, and ties, and issue payment upon receipt and verification of the golf balls. All quotes provided are estimates and are subject to verification upon physical inspection of the golf balls received.
By submitting golf balls to SellMyGolfBalls.com, you represent and warrant that:
All quotes provided are estimates based on the information you provide. An accepted offer is valid for 7 days from the date it is sent, after which it expires and a new quote is required.
Our count is the official count and is the basis on which payment is made. We count within 2 business days of delivery and notify you of the result.
Final payment amounts are determined after physical inspection and grading of the golf balls received. We reserve the right to adjust the final payment amount based on the actual condition, brand, and quantity of golf balls received. Where a shipment includes range balls, practice balls, logo overruns, cracked or waterlogged balls, or any item that is not a usable golf ball, we will pay only for the golf balls we are able to resell.
If the golf balls received are materially different from those described in your submission, we may cancel the transaction rather than adjust the price. In that event you must choose, within 5 days of our notice, either to have the shipment returned to you at your expense or to have it disposed of at no charge to either party. If you do not respond within 5 days, we may dispose of the shipment at our discretion and no payment will be due.
Upon using our prepaid shipping label and sending your golf balls, you agree that ownership of the golf balls transfers to SellMyGolfBalls.com upon our receipt and acceptance of the shipment. We are not responsible for golf balls lost, stolen, or damaged during shipping, and payment is due only for golf balls that physically reach our facility and are counted. We recommend keeping tracking information for your records. Shipments must be sent within 14 days of receiving your kit, and after 30 days we may cancel or requote the transaction.
The bags, prepaid labels, and other kit materials we send remain our property until they are used for the transaction for which they were issued. They may be used only to ship the golf balls covered by that transaction. If our prepaid labels are used to ship any other goods, or if you do not ship at all, we may invoice you for the postage and the cost of the kit.
Payment will be issued within 1 business day of the count being completed, using the payout method and details you provide at the time you accept an offer. Payment methods include Bank Wire, PayPal, Venmo, Zelle, and check. You are responsible for providing accurate payment information. We are not responsible for delays or issues caused by incorrect payment information. If a payment is returned to us, we will contact you once and hold the funds until you provide corrected details. All payments are final once issued.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SELLMYGOLFBALLS.COM AND ITS OWNERS, OPERATORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID OR PAYABLE TO YOU FOR THE GOLF BALLS IN QUESTION.
You agree to indemnify, defend, and hold harmless SellMyGolfBalls.com and its owners, operators, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your breach of these Terms, your violation of any law or regulation, or your violation of any third-party rights.
Any disputes arising out of or related to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in the state where SellMyGolfBalls.com is headquartered. You agree to waive any right to a jury trial or to participate in a class action lawsuit.
These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which SellMyGolfBalls.com operates, without regard to conflict of law principles.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
These Terms constitute the entire agreement between you and SellMyGolfBalls.com regarding the use of the Service and supersede any prior agreements or understandings.
